Subject of the Agreement
Under the Agreement, you will be entitled to use the Unit, Common Areas, and a Parking Space (if you selected one in the reservation process) for temporary accommodation provided for the purpose of pursuing higher education, postgraduate studies, or professional development, or for other similar educational or training purposes.
Conditions for the Agreement to Take Effect
The Agreement will take effect once the Administrative Fee and the Deposit have been paid in full and on time, as specified in the Agreement.
Accommodation Period
The Agreement is concluded for a fixed term, selected by you during the contracting process. The Accommodation Period will commence no later than the Unit Handover Date, which is the date you are given access to the Unit.
Early Termination of the Agreement
The Agreement cannot be terminated before the expiry of the specified Accommodation Period. However, if the Unit has Material Defects that prevent you from using it or if StudentSpace fails to hand over the Unit on the agreed date, you may terminate the Agreement early under the conditions specified in § 6 of the Agreement.
Additionally, as per § 10, early termination of the Agreement may be possible by mutual consent between you and StudentSpace. In such cases, early termination may involve additional fees to compensate StudentSpace for any losses incurred as a result. The financial terms of early termination will be determined individually on a case-by-case basis.
Termination the Agreement if you are not admitted to university
If you are not admitted to any higher-education studies in the city where the Building is located, for the academic year covered by the Agreement, you can terminate the Agreement with immediate effect. Just send a statement to hello@studentspace.pl before the Handover Date and no later than 30 September of the year in which that academic year begins, and attach proof of the unsuccessful admission (an official university document or a printout from the admissions system, e.g. IRK, with data matching the Agreement). We will then refund all amounts you have paid within 14 days, except for the non-refundable Administrative Fee (which covers the costs of setting up the Agreement). This right expires once you take possession of the Unit (including unilateral handover).
Termination of the Agreement before Handover of the Unit
If you previously had an agreement with StudentSpace (or a company from its group) that StudentSpace terminated, or during which you breached the Agreement or the Terms of Use in a manner justifying termination, StudentSpace may terminate the newly concluded Agreement no later than the day the Unit is handed over to you. In such a case, StudentSpace will refund all amounts you paid during the contracting process.
Termination of the Agreement within 48 hours of conclusion due to extraordinary circumstances
Within 48 hours of concluding the Agreement, StudentSpace may terminate it with immediate effect if making the Unit available proves impossible or materially hindered, e.g. due to a lack of available Units of the given type (overbooking), a system failure, or other extraordinary circumstances. In such a case, we will refund all amounts you have paid, including the Administrative Fee, within 14 days of the date the termination notice is sent.
Confirmation of education and age criterion
StudentSpace may, at any time, ask you for documents confirming that you are pursuing education and therefore using the Unit in accordance with the Permitted Use. If, within 21 days of the request, you fail to provide them or they do not show that you have undertaken education, StudentSpace may terminate the Agreement with immediate effect. StudentSpace may also terminate the Agreement with immediate effect if it turns out that, as at the date the Agreement was concluded, you had reached the age of 35.
Payments
Entering into the Agreement requires the following payments:
- Administrative Fee – a one-time fee of 300 PLN (gross), payable within 3 days from the date of signing the Agreement, covering StudentSpace’s costs related to the contracting process.
- All-Inclusive Fee – a monthly fee payable from the Unit Handover Date until the Agreement Expiry Date, constituting StudentSpace’s compensation for your right to use the Unit.
- Parking Space Fee – a monthly fee payable from the Unit Handover Date until the Agreement Expiry Date, if you selected a Parking Space in the Agreement.
The above fees constitute the total gross amount due to StudentSpace for your use of the Unit, Common Areas, and Parking Space (if selected). The All-Inclusive Fee also covers utility costs and internet services.
Additional Fees
In addition to the above payments, you may be charged additional fees, depending on how you use the Unit:
- Additional Services Fees – StudentSpace offers various additional services (such as overnight guest stays) that you may choose to use. The current price list for Additional Services is provided in Schedule 2 to the Agreement. The first five guest overnight stays during the Accommodation Period are free of charge, and each subsequent one is payable in accordance with Schedule 2; instead of paying for individual overnight stays, you may also purchase an Overnight Subscription, which allows one guest to stay overnight with you throughout the paid month.
- Repair fees – if you cause damage to the Property, including the Unit and Common Areas, or their furnishings, you may be charged for repairs in accordance with the price list attached to the Agreement.
- Fee for calling emergency Services – if emergency services are called due to improper use of the Property, you may be charged for the costs incurred, plus a contractual penalty of 200 PLN (gross) to cover administrative costs related to handling the incident.
- Penalty for violating the Terms for Using the Unit and Common Areas – if you do not comply with the Terms for using the Unit and Common Areas, you may be charged a contractual penalty of 200 PLN (gross) for each violation.
- Cleaning fee – if the Unit is not cleaned before being returned to StudentSpace, you may be charged a cleaning fee.
- Penalty for failure to make the Unit available for inspection (Unit return) – if you do not make the Unit available for the preparation of the Handover Protocol concerning return of the Unit, you may be charged a contractual penalty of 500 PLN (gross).
Payment Deadlines
Fees due under the Agreement are payable within 10 days of receiving the relevant invoice, except for the fees for the first month of the Accommodation Period, which must be paid within 7 days before the Scheduled Unit Handover Date.
The invoice for the first month of the Accommodation Period will be issued promptly upon signing the Agreement.
All payments must be made to the Payment Account specified in the Agreement.
Deposit
The Deposit secures the timely and proper payment of fees under the Agreement. The conditions under which StudentSpace may use the Deposit are specified in § 5 of the Agreement. If StudentSpace deducts any amount from the Deposit, you must replenish it accordingly.
Your Deposit will be refunded within 30 days after the Agreement Expiry Date, provided you have indicated the bank account to which the refund should be made.
If you conclude another accommodation agreement with StudentSpace or another company from the StudentSpace capital group (for example, for another semester or academic year, or for a unit in another StudentSpace private dormitory), and your Deposit paid under this Agreement has not yet been refunded to you, you consent to the remaining refundable part of the Deposit being credited towards the deposit due under the new agreement. You may withdraw this consent at any time - simply write to us at hello@studentspace.pl. If you withdraw your consent, we will refund your Deposit under the general rules.
Returning the Unit
You must return the Unit and Parking Space (if applicable) by no later than 10:00 AM on the Agreement Expiry Date. The returned Unit must be in good condition (allowing for normal wear and tear), cleaned, hygienic, free of personal belongings with all keys and any additional equipment provided.
A Handover Protocol will be prepared at the time of returning the Unit. This protocol will be prepared no earlier than 14 days before the Agreement Expiry Date. You are required to provide access to the Unit for the preparation of the Handover Protocol on a date mutually agreed upon with StudentSpace, within the indicated timeframe.
If you fail to return the Unit on time, you may be charged a contractual penalty equal to 1/31 of the All-Inclusive Fee per day of delay.
Responsibility for Guests and Co-Accommodated Person
If you have guests or if your Agreement includes a Twin Flat, you will be jointly liable for any damage or misconduct caused by your guests or Co-Accommodated Persons.
Visa and Residency Permits
If you are a foreigner requiring a visa or residence permit to stay in Poland, you must notify StudentSpace about the status of these documents at least 30 days before the scheduled Unit Handover Date.
If you do not have a valid visa or residence permit 30 days before the scheduled Unit Handover Date, StudentSpace may terminate the Agreement.
Additional Information
You cannot register for permanent residence (zameldowanie) in the Unit, conduct commercial activities there, or register a business at the Unit (zarejestrowanie działalności gospodarczej).
StudentSpace is not responsible for damage or theft of your personal property (e.g., car, scooter, bicycle). The Property is insured only for its fixed elements and furnishings; you must insure your personal belongings separately.
Temporary utility disruptions (e.g., internet, water or power outages) may occur, and StudentSpace's liability for such events is limited.
Payment Processing Fees
If you choose to payfees under the Agreement via third-party payment gateways, additionalprocessing fees may apply. These fees are not included in the fees requiredunder the Agreement. However, you can avoid these fees by making payments viastandard bank transfer.
Contact and Complaints
You can find the phone number and email for contacting StudentSpace in the Specific Conditions of the Agreement or use the Student Portal.
Complaints should be submitted via mail, the Student Portal, or email: reklamacje@studentspace.pl. In your submission, please provide your first name, surname, email address and the reason for the complaint. Complaints will be reviewed within 14 days, and if additional information is needed, you will be asked to provide it within 7 days. In such a case, the 14-day response period shall commence from the moment you provide the missing information.
No Right to Withdraw – Consumer Law
Pursuant to Article 38(1)(12) of the Act of 30 May 2014 on Consumer Rights, a consumer who enters into a distance or off-premises contract for services related to accommodation other than for residential purposes is not entitled to the right of withdrawal from the contract. As the subject of this Agreement is accommodation other than for residential purposes—specifically, temporary accommodation related to pursuing higher education, postgraduate studies, professional development, etc.—you do not have the right to withdraw from this Agreement.
In accordance with the Consumer Rights Act, if a trader fails to fulfill their information obligations regarding additional fees or other costs, the consumer is not liable for such fees and costs.
